Terms and Conditions of Sale

These general terms and conditions of sale (hereinafter the ‘GTC’) govern all contractual relationships between TECHORA, a sole trader operated by Aras Keklik, with its registered office at Promenade du Voisinage 7, 1217 Meyrin (Switzerland) (hereinafter “TECHORA”, “we”), and any natural or legal person (hereinafter the “Customer”, “you”) placing an order on the techora.ch website (hereinafter the “Website”). They apply to both product sales and subscriptions. By confirming an order or a subscription, the Customer declares that they have read these T&Cs and accept them in full and without reservation.
1. Purpose and scope
The purpose of these T&Cs is to define the rights and obligations of the parties in connection with the online sale of connected devices (NFC/QR), accessories, bundles and service subscriptions offered by TECHORA. They apply to the exclusion of all other terms and conditions. TECHORA reserves the right to amend these T&Cs at any time; the applicable T&Cs are those in force on the date of the order.
2. Products and services
TECHORA sells NFC and QR media (plates, cards, stickers, table stands, etc.) which, amongst other things, enable redirection to a web page (Google reviews, menus, social media, Wi-Fi, etc.), accessories, customisable packs, as well as subscriptions providing access to additional services (advanced management, statistics, priority support, etc.).
The key features of the products and services are set out in the relevant product descriptions. Photographs and illustrations are provided for information purposes only and are not contractually binding. TECHORA endeavours to ensure their accuracy but cannot be held liable for minor errors or omissions.
3. Prices
Prices are quoted in Swiss francs (CHF). Unless otherwise stated, they exclude delivery charges, which are specified before the order is confirmed. TECHORA reserves the right to amend its prices at any time, on the understanding that products are invoiced on the basis of the prices in force at the time the order is confirmed.
The final price of each order is calculated and verified by our servers using our database at the time of payment. In the event of a clear discrepancy (an obvious pricing error), TECHORA reserves the right to cancel the order and refund the Customer.
4. Order
The Customer selects the products, completes their delivery details (compulsory) and confirms their order. Confirmation of the order implies acceptance of these Terms and Conditions of Sale. The sale is deemed to have been concluded upon confirmation of payment. TECHORA reserves the right to refuse or cancel any order placed by a Customer with whom there is an outstanding dispute, or for any legitimate reason.
A confirmation email summarising the order is sent to the Customer. The Customer is responsible for the accuracy of the information provided (address, contact details, configuration links). TECHORA cannot be held liable for the consequences of incorrect or incomplete information.
5. Payment
Payment is made online at the time of ordering, using the payment methods offered on the Website (in particular credit cards). Payments are processed securely by our service provider, Stripe. TECHORA never has access to the Customer’s full card details and does not store them.
The order is only processed once payment has been successfully authorised. If payment is declined, the order is automatically cancelled. The Customer warrants that they have the necessary authorisation to use the chosen payment method.
6. Subscriptions — sign-up, renewal and cancellation
Certain services are offered as monthly or annual subscriptions, depending on the plan chosen by the Customer. By subscribing, the Customer authorises TECHORA (via Stripe) to automatically debit, on a recurring basis, the amount corresponding to the chosen plan and frequency, until cancellation.
Renewal: the subscription is automatically renewed on each due date (monthly or annually) for the same duration, at the current rate, unless cancelled by the Customer before the due date.
Cancellation: the Customer may cancel their subscription at any time, free of charge and without giving a reason, via their customer portal (under the ‘My subscription’ section). Cancellation takes effect at the end of the current period for which payment has already been made: the Customer retains access to the services until that renewal date, and no further direct debits will be taken thereafter. Amounts already paid for the current period will not be refunded on a pro rata basis.
Failed payment: in the event of a failed recurring payment (e.g. expired card, insufficient funds, etc.), TECHORA will notify the Customer and may suspend or cancel the subscription if the matter is not resolved within a reasonable period.
TECHORA reserves the right to amend subscription rates; any such amendment shall be notified to the Customer and shall apply from the next due date, whilst the Customer remains free to cancel the subscription before the amendment comes into effect.
7. Delivery
Products are delivered to the address specified by the Customer at the time of ordering, within Switzerland. Delivery times are provided for guidance only; dispatch usually takes a few working days, followed by delivery by the carrier (usually Swiss Post), taking an average of 3 to 4 working days.
A tracking number is provided to the Customer upon dispatch. TECHORA cannot be held liable for delays attributable to the carrier or to force majeure. The risks associated with transport are transferred to the Customer upon delivery of the parcel.
TECHORA also ships to certain European countries. For all deliveries outside Switzerland, customs duties and VAT applicable in the destination country may be charged by the carrier upon receipt. Any such costs are payable by the Customer and are not included in the displayed price.
8. Right of withdrawal and returns
In accordance with standard practice and in a spirit of trust, TECHORA offers the Customer the option to return a non-personalised product, in its original condition, within 14 days of receipt. Return costs are the responsibility of the Customer, unless there has been an error on our part.
The right of return does not apply to personalised products or those specifically configured at the Customer’s request (pre-programmed devices with a specific link), nor to subscription services that have already been activated, as these are provided upon subscription.
9. Statutory warranty and conformity
Products are covered by the statutory warranty against defects in the goods sold, as provided for in the Swiss Code of Obligations. In the event of a proven defect affecting a product, TECHORA shall, at its discretion, repair, replace or refund the product in question. The guarantee does not cover normal wear and tear, damage resulting from improper use, negligence or modification by the Customer.
10. Service Availability and Liability
TECHORA makes every effort to ensure the availability and proper functioning of the Website and associated services (media redirection, dashboard, etc.). However, TECHORA cannot guarantee uninterrupted availability and shall not be held liable for temporary interruptions due to maintenance, technical incidents or third-party service providers.
TECHORA’s liability is limited to the amount of the relevant order or subscription. TECHORA shall not be held liable for indirect damages (loss of turnover, loss of customers, etc.). No provision herein is intended to exclude TECHORA’s liability in the event of gross negligence or wilful misconduct.
11. Intellectual Property
All elements of the Website (the TECHORA brand, logo, text, visuals, interface and code) are protected by intellectual property law and remain the exclusive property of TECHORA. Any unauthorised reproduction or use is prohibited.
12. Personal Data
The processing of the Customer’s personal data is described in our Privacy Policy, which is available on the Website. By placing an order, the Customer consents to such processing in accordance with the terms set out therein.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by Swiss law. Any dispute relating to their interpretation or enforcement falls within the exclusive jurisdiction of the courts of TECHORA’s registered office in Meyrin (Canton of Geneva), subject to mandatory provisions protecting consumers.
